Who we are

These terms govern your use of VidBud ("VidBud", "we", "us"), an AI creative platform available at vidbud.io. By creating an account or using the service you agree to these terms.

Accounts

You are responsible for the activity on your VidBud account and for keeping your credentials secure. You must provide accurate account information and be legally able to enter into these terms.

Subscriptions and credits

Plans renew monthly and include monthly AI credits that do not roll over. Purchased top-up credits roll over while your account remains active. Pricing and plan inclusions are shown at checkout and on the pricing page.

AI-generated content and results

VidBud uses artificial intelligence and third-party AI service providers to generate videos, images, scripts, advertising copy, creative concepts and other content ("AI-Generated Content"). Generative AI is probabilistic by nature. VidBud does not guarantee that AI-Generated Content will exactly match your instructions, reference materials, expectations, intended appearance, creative vision or desired commercial outcome.

AI-generated outputs may contain variations, inaccuracies, visual or audio artifacts, inconsistencies, unexpected interpretations or other imperfections. Results may vary between generations even when similar instructions or source materials are used. You are responsible for reviewing AI-Generated Content before publishing, distributing, advertising or otherwise using it. VidBud does not guarantee advertising performance, conversions, sales, revenue, ROAS, profitability or other business results from AI-Generated Content.

Credits and AI generation charges

VidBud credits represent usage of platform features and computational resources. When a credit-consuming generation or operation is successfully submitted and processed, the applicable credits may be consumed. VidBud incurs costs from third-party AI infrastructure and service providers when processing generation requests.

Accordingly, credits consumed for a successfully processed AI generation are generally non-refundable solely because you dislike the result, the output differs from subjective expectations, you change your mind, you choose not to use the output, or another generation produces a different result. A creatively unsatisfactory result by itself is not considered a technical failure of the service.

Technical failures and remedies

VidBud may restore credits or provide another appropriate remedy for verified circumstances such as:

• a generation request failed and no usable generation was delivered;
• a duplicate credit deduction;
• a duplicate payment;
• a verified VidBud technical failure;
• other circumstances where required by applicable law.

Where a generation job fails, the platform's existing automatic credit-release behaviour continues to apply. Nothing in these terms is intended to waive or limit rights that cannot lawfully be waived, including any mandatory consumer rights in your jurisdiction.

Your responsibility for generated content

You are responsible for reviewing generated content before any commercial use, including checking:

• factual accuracy
• claims and substantiation
• prices and offers
• product information
• legal and regulatory claims
• trademarks
• copyright
• publicity and personality rights
• advertising and platform policy compliance

VidBud does not guarantee that every AI output is automatically legally compliant for every jurisdiction, market or industry.

Content you upload

You may upload product photos, logos, creator or model photos, reference videos, brand assets, scripts and other materials. You represent that you own or hold all necessary rights, licenses, permissions and consents to upload and use those materials, and for photos or videos depicting people, that you have appropriate permission to use that person's image and likeness where required.

You keep ownership of your original uploaded materials. Uploading does not transfer ownership of them to VidBud. You grant VidBud only the permissions needed to host, process and generate content for you, and to operate and support the service. Rights and likeness confirmations you make in the product are recorded with your account.

Prohibited use

You must not use VidBud for:

• unlawful activity or fraud;
• copyright or trademark infringement, including copying another advertiser's advertisement;
• unauthorized use of third-party creative assets, logos or brand assets;
• unauthorized use of a person's likeness, including face swaps, deepfakes, voice impersonation or voice cloning intended to impersonate a real person;
• deceptive impersonation of a person, brand or organisation, or presenting an AI-generated person as a real customer, expert, employee or spokesperson without authorization;
• abuse of the platform, including attempts to bypass credit, metering or payment systems, or to disrupt or reverse engineer the service.

Creative produced with VidBud must comply with the advertising policies of the platforms you publish on and with applicable law.

Reference analysis and original output

VidBud analyzes creative patterns and generates original content. It does not reproduce or redistribute third-party advertisements. Reference analysis produces an abstract read of creative characteristics such as hook structure, pacing, shot types, framing and messaging approach, and that read is used to write an original concept for your own product and brand. VidBud claims no affiliation with any third-party brand referenced by a customer.

Third-party providers

VidBud relies on third-party infrastructure, AI model and service providers, payment processors and analytics providers to deliver parts of the service. Provider availability, changes or outages may affect features, output characteristics or processing times. We do not publish confidential provider routing or internal architecture details.

Enforcement

We may suspend or terminate accounts, and remove or refuse to process content, that we reasonably believe infringes intellectual property rights, uses a person's likeness without permission, or otherwise violates these terms.

Service availability and liability

The service is provided on an "as is" and "as available" basis to the extent permitted by law. To the maximum extent permitted by applicable law, VidBud is not liable for indirect, incidental or consequential loss, including lost profits, advertising spend or business results. Nothing here limits liability that cannot lawfully be limited.

Changes

We may update these terms as the platform evolves and will publish the current version on this page. Material changes may require you to accept the updated terms before continuing to use the service.
